Commercial Adversary Proceedings

We also represent business creditors in cases in which a larger corporation, such a major supplier, is filing bankruptcy and attempting to discharge debt owed to the business creditor. We file motions for relief of stay for such vendor-creditors who wish to proceed in state court in order to get their property back. We also handle preference actions in cases in which creditors clients were paid within 90 days of the filing of bankruptcy. We are often able to negotiate a deal with the bankruptcy trustee in which at least some of the payment is retained by creditor clients.
